| Most sales of personal property are recorded by a
bill of sale and nothing more. A bill of sale is a document stating that title (ownership)
to the personal property described in the bill of sale has been transferred by the seller
to the party named in the bill of sale. The form should precisely describe the property
sold. Describe the property as exactly as is possible; list any serial numbers, color,
date of manufacture, model, brand, etc. The bill of sale should state the consideration
(price paid). It should also state that the seller will undertake to defend the buyer's
title to the property against any third party claims. Certain items such as automobiles and motorcycles have certificates of title that contain provisions for a clearly defined transfer of ownership. But other valuable items such as guns, trailers, tools, artwork, computers, furniture, boats, etc. that do not have a certificate of title form must have a bill of sale to prove and establish a legal transfer of ownership. To not have this legal document which proves that you now have ownership of any valuable piece of personal property is to invite trouble. In the special case of a bill of sale for an airplane (aircraft), the 1958 Federal Aviation Act provides that any transfer of title of any civil aircraft must be recorded with the Federal Aviation Authority (FAA). In such a case, the FAA Registration Number of the aircraft must be listed in the bill of sale form, and the document must be recorded with the FAA.
